The online gallery allows clients to view, download, and/or purchase photos from sessions or events captured by Zoe Patchett.
2. Access and Use of the Gallery
Access to the gallery is granted solely to the client for whom the photographs were taken, unless otherwise agreed upon.
Clients are responsible for maintaining the confidentiality of their gallery access credentials.
You may view, download, and share images from the gallery only in accordance with the terms specified here.
3. Image Usage and Copyright
All images provided through the gallery are the intellectual property of Zoe Patchett. Copyright remains with Zoe Patchett, unless otherwise specified.
Clients may download images for personal use or as specified in their individual contract.
Commercial use of images is strictly prohibited unless a separate agreement or license has been established.
Zoe Patchett retains the right to use any images for marketing, portfolio, and promotional purposes unless otherwise agreed in writing.
4. Download and Print Rights
Clients who have purchased a download or print release may reproduce the images for personal use only.
Images may not be edited, altered, or manipulated in any way that misrepresents the original work without written permission.
High-resolution images are provided without watermarks, and clients are encouraged to credit the photographer if images are shared online or in publications.
5. Payment and Licensing Fees
If the gallery is used for selecting images for purchase, clients agree to the pricing structure outlined within the gallery or contract.
Any unauthorised commercial use of the images may result in additional licensing fees.
6. Third-Party Sharing and Liability
Clients who share access to the gallery or images with third parties (e.g., family members, friends, other vendors) are responsible for ensuring that such parties adhere to these terms of service.
Zoe Patchett is not liable for any third-party use or misuse of the images once access is shared by the client.
7. Limitation of Liability
Zoe Patchett is not responsible for any technical issues, such as server downtime, corrupted files, or the unavailability of the gallery.
While every effort is made to maintain the security of the gallery, Zoe Patchett is not liable for any unauthorised access or data breaches.
8. Image Availability and Archiving
Images will remain accessible through the gallery for the duration outlined in each individual contract, after which they may be archived. It is the client's responsibility to download and back up images within this time frame.
A fee may be charged for re-activating archived galleries after the initial availability period.
9. Privacy
Zoe Patchett will handle all personal data provided during gallery access in accordance with our Privacy Policy. We do not share client information with third parties without consent, except as necessary for the functioning of the gallery (e.g., third-party payment processors).
10. Termination of Access
Zoe Patchett reserves the right to terminate gallery access at any time, particularly in cases of violation of these terms, abuse, or failure to comply with payment terms.
11. Modifications to Terms
These Terms of Service may be updated periodically. Clients will be notified of any significant changes via email or when accessing the gallery.
12. Governing Law and Disputes
These terms will be governed by the laws of the United Kingdom. Any disputes arising from the use of the gallery will be resolved through legal proceedings as specified by Zoe Patchett.
